PENAL CODE, 1860 Evidence of witnesses corroborated to each other - Medical evidence corroborated with the ocular testimony as well as the extra judicial confession - Held accused is the author of the crime though there is no material to show the existence of positive intention of the accused - Assault at the power of the moment because of heaf of passion - Conviction altered to owe under Section 304 Part II I.P.C. - Plea that the offence is under one 304-A I.P.C. cannot be accepted.
